These terms and conditions form a binding agreement between Oates Consult Limited of The Studio, Wellingore Heath, Lincoln, LN5 0DA, trading as gocompensate.com (hereinafter referred to as 'the company') on the one part and the gocompensate.com panel solicitor (herinafter referred to as 'the client') on the other and users of the service otherwise referred to as 'potential claimants'.

Panel Membership
1.1 The client agrees that by instructing Oates Consult Limited or its appointed agent to reserve a panel placement on the gocompensate.com website it accepts that it has made an order for a dedicated webpage to be constructed for the purposes of promoting its personal injury and/or medical negligence services.

1.2 The company will construct a draft webpage for the client upon receipt of the order and will make the same available for the client's perusal within a reasonable period of time from the date of receiving the order (and in any event within 7 days).

1.3 The client agrees to respond to the company with any recommendations for improvement, alternative text to be used and/or images within a reasonable period of time (and in any event within 14 days of receiving the draft).

1.4 Upon approval of the draft webpage the company will then upload the link from the main gocompensate.com website and submit its account for charges incurred and agreed between the parties.

1.5 The link will remain live on the gocompensate.com website for a period of 12months and shall remain on the site should the client wish to secure the service for a following year.

1.6 All firms of solicitors listed on the gocompensate.com website shall be given first refusal to renew its panel membership for following years and shall be accepted by the company provided that it has no outstanding accounts due to Oates Consult Limited and subject to maintaining their accreditations to either Lexcel, Law Society Personal Injury Panel, Law Society Clinical Negligence Panel and/or Association of Personal Injury Lawyers or by continuing to provide personal injury services for a period in excess of five years.

The client agrees that:
2.1 It will provide a free initial appointment to any client whose enquiry was generated from the gocompensate.com and that reasonable endeavours are implemented to ascertain the origin of the client enquiry.

2.2 It will settle any accounts due to Oates Consult Limited within 14 days otherwise accepts that any preferential listing within a panel shall in the first instance be deactivated. If payment remains outstanding at 30 days then the company is at liberty to remove the listing altogether and submit an administration charge for £250 plus VAT with no obligation on its part to promote the client's services. All cheques to be made payable to 'Oates Consult Limited'

2.3 It will at all material times do what is within its reasonable endeavour to maintain that its website is available for enquiries generated from the gocompensate.com website and that the content of such website shall not contain material that users may find offensive in any way.

The company agrees that:
3.1 Upon receipt of the agreed fee it shall upload the client webpage link to the gocompensate.com website and shall carry out all reasonable endeavours to promote the client and the gocompensate.com brand.

Potential Claimants
4.1 By using this service potential claimants accept that Oates Consult Ltd T/a gocompensate.com cannot accept any liability for the advice provided by the panel solicitor and that all firms listed on this site are provided in good faith and in conjunction with the law firm confirming that it meets our requirements as defined in Section 1.6 of this agreement.

4.2 All links to external websites are provided for potential claimants to obtain further information on applicable services and Oates Consult Ltd cannot accept any responsibility for the content of any external website nor any viruses that may be attached.

4.3 No claim shall be considered accepted by either gocompensate.com or any panel solicitor until the claimant has received written notification of acceptance from the panel solicitor. Where a claim is close to becoming statute barred through limitation on time from the date of accident/injury (usually three years) then the claimant should not assume allocation and acceptance through gocompensate.com over the internet.

The applicable law for any disputes that may arise shall be deemed under the jurisdiction of the courts of England and Wales.

The name gocompensate and all subdomains are subject to copyright and protected by Oates Consult Limited. The format of providing niche firms within a geographic location is also copyright protected by Oates Consult Limited.
